Terms of Use (INDUSTQA)

These Terms of Use (“Terms”) govern your access to and use of the INDUSTQA website, applications, and related services (collectively, the “Services”). INDUSTQA is an online question‑and‑answer and knowledge‑sharing platform focused on manufacturing, industrial engineering, and smart manufacturing, operated by Tianjin MXK Intelligent Tech Co., Ltd.

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not access or use the Services.

1. Eligibility and Account Registration

1.1 Eligibility

You must be at least the minimum age required by applicable law (for example, 13 or 16 years old) and have the legal capacity to enter into a binding contract to use the Services. If you use the Services on behalf of a company or other entity, you represent and warrant that you are authorized to bind that entity to these Terms.

1.2 Account Registration

To use certain features, you must create an account and provide accurate and complete information. You agree to:

Keep your account information up to date;

Maintain the confidentiality of your login credentials; and

Be responsible for all activities that occur under your account.

1.3 Security

You must promptly notify us if you suspect any unauthorized use of your account or any other security breach. We are not liable for any loss or damage arising from your failure to safeguard your account.

2. Description of the Services

INDUSTQA provides tools and features that may include, but are not limited to:

Posting and browsing questions and answers related to manufacturing and industrial topics;

Publishing and viewing articles, columns, and technical content;

Following tags, topics, and experts;

Participating in discussions and private messaging (if enabled);

Accessing or purchasing premium content, membership plans, or other services (if enabled).

We may modify, suspend, or discontinue any part of the Services at any time, with or without notice, and without liability to you.

3. Industrial and Confidential Information

3.1 No Classified or Export‑Controlled Data

INDUSTQA is not designed or intended for the upload, storage, or processing of:

Classified, export‑controlled, or otherwise restricted technical data (including data subject to ITAR, EAR, or similar regulations);

Trade secrets or confidential manufacturing process details that your organization considers highly sensitive;

Information restricted by nondisclosure agreements or internal corporate policies.

You are solely responsible for ensuring that any information you share complies with your legal and contractual obligations, as well as your employer’s internal rules.

3.2 No Real‑Time Control or Safety‑Critical Use

The Services are not intended for:

Real‑time control of machinery, robots, production lines, or safety‑critical systems;

Emergency or life‑critical decision‑making.

Any technical advice, examples, or recommendations on the platform are general in nature. You must perform your own verification, risk assessment, and safety checks before applying any information in real systems.

4. User Content

4.1 Definition

“User Content” means any content you submit, upload, post, or otherwise provide through the Services, including questions, answers, comments, articles, code snippets, drawings, documents, images, and profile information.

4.2 Your Responsibility

You are solely responsible for your User Content and for ensuring that it:

Is accurate, lawful, and appropriate;

Does not violate any third‑party rights (including intellectual property, privacy, and confidentiality);

Does not contain classified, export‑controlled, or otherwise restricted information;

Complies with these Terms and all applicable laws and regulations.

4.3 License You Grant to INDUSTQA

By submitting User Content, you grant Tianjin MXK Intelligent Tech Co., Ltd. and INDUSTQA a worldwide, non‑exclusive, royalty‑free, transferable, sublicensable license to:

Use, host, store, reproduce, modify, adapt, translate, distribute, publicly display, publicly perform, and create derivative works of your User Content,

For the purpose of operating, improving, promoting, and providing the Services, including in search results, recommendations, emails, and other features.

Where permitted by applicable law, this license continues even if you stop using the Services, subject to any removal or anonymization options we may provide.

4.4 Public Nature of Content

Much of the User Content on INDUSTQA is public and may be indexed by search engines. Do not submit content that you do not intend to make publicly available (unless the specific feature clearly indicates otherwise).

4.5 Content Removal

We reserve the right (but do not have the obligation) to remove or disable access to any User Content at our sole discretion, including if it violates these Terms or applicable law. We may also edit or moderate content to the extent necessary to enforce policies or improve clarity, without assuming any responsibility for your User Content.

5. Prohibited Conduct

You agree not to:

Use the Services for any unlawful, fraudulent, or malicious purpose;

Post, upload, or share:

Illegal, defamatory, misleading, or deceptive content;

Hate speech, harassment, threats, or abusive material;

Pornographic, obscene, or otherwise inappropriate content;

Spam, promotional content, or unsolicited advertising not expressly allowed;

Infringe or misappropriate any intellectual property or other rights of any person or entity;

Reverse engineer, decompile, or attempt to derive the source code of any part of the Services (unless permitted by law);

Interfere with or disrupt the operation of the Services or any servers, networks, or systems connected to them;

Attempt to bypass any security or access controls;

Impersonate any person or entity, or misrepresent your affiliation with any person or entity;

Engage in any activity that could damage the reputation or integrity of INDUSTQA or its users.

We may investigate and take any appropriate action for violations of these Terms, including account suspension or termination and cooperation with law enforcement authorities.

6. Intellectual Property

6.1 Our Rights

The Services, including all software, design, text, images, logos, trademarks, and other content (excluding User Content), are owned by or licensed to Tianjin MXK Intelligent Tech Co., Ltd. and are protected by intellectual property and other laws.

You are granted a limited, non‑exclusive, non‑transferable, revocable license to access and use the Services for your personal or internal business purposes, in accordance with these Terms.

6.2 Third‑Party Content

Certain content or features may be provided by third parties. All such content is the responsibility of its respective owner and may be subject to additional terms and conditions.

6.3 Feedback

If you submit feedback, suggestions, or ideas regarding the Services, you agree that we may use them without restriction or compensation to you.

7. Payments, Subscriptions, and Premium Features (If Applicable)

7.1 Paid Services

INDUSTQA may offer paid features, subscriptions, digital content, or other services. Prices, descriptions, and terms of use for these paid offerings will be provided at the point of purchase.

7.2 Billing and Payment

By providing payment information, you represent and warrant that you are authorized to use the chosen payment method and authorize us or our payment processors to charge the applicable amounts.

7.3 Renewals and Cancellations

For subscription services, details about renewal, cancellation, and termination will be provided at the time of purchase. You are responsible for managing your subscription settings and cancellations in accordance with those terms.

7.4 Refunds

Refund policies, if any, will be disclosed at the time of purchase or in separate refund guidelines. Except as required by applicable law or our published policy, all payments are non‑refundable.

8. Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using the Services, you acknowledge that you have read and understood the Privacy Policy.

9.1 No Professional Advice

Content on INDUSTQA is contributed by users and may include technical advice, opinions, and examples related to manufacturing, industrial engineering, and other fields. Such content is for informational purposes only and does not constitute professional, legal, engineering, safety, or compliance advice.

You are solely responsible for verifying any information, conducting your own testing and risk assessments, and obtaining professional advice where appropriate before implementing any solution in industrial or safety‑critical environments.

9.2 “As Is” and “As Available”

The Services are provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, either express or implied, including but not limited to:

Warranties of merchantability, fitness for a particular purpose, non‑infringement, or course of performance;

Any warranty that the Services will be uninterrupted, error‑free, secure, or free of harmful components;

Any warranty regarding the accuracy, completeness, or reliability of content (including User Content).

You use the Services at your own risk.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

Tianjin MXK Intelligent Tech Co., Ltd., INDUSTQA, and their affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising out of or related to your use of or inability to use the Services;

Our total aggregate liability for all claims arising out of or relating to the Services or these Terms shall not exceed the greater of:

The amount you paid to us (if any) for the Services during the twelve (12) months immediately preceding the event giving rise to the claim; or

One hundred (100) US dollars (or the equivalent in your local currency).

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you. In such cases, our liability will be limited to the fullest extent permitted by applicable law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Tianjin MXK Intelligent Tech Co., Ltd., INDUSTQA, and their affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:

Your use of the Services;

Your User Content;

Your violation of these Terms;

Your violation of any rights of another person or entity;

Your misuse of any industrial or technical information obtained through the Services.

12. Termination and Suspension

We may, at our sole discretion, suspend or terminate your access to all or part of the Services at any time, with or without notice, including (but not limited to) when:

You violate these Terms or any applicable law;

We are required to do so by law or by a court/authority;

We discontinue or materially modify the Services.

You may stop using the Services at any time. Certain provisions of these Terms, by their nature, will survive termination (including, but not limited to, Sections on Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law).

13. Governing Law and Dispute Resolution

These Terms and any dispute arising out of or relating to them or the Services shall be governed by and construed in accordance with the laws of the People’s Republic of China, without regard to its conflict of law principles.

Any disputes shall be submitted to the exclusive jurisdiction of the competent courts located in Tianjin, China, unless mandatory consumer protection laws in your country of residence provide you with additional rights or different dispute resolution requirements.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will:

Update the “Last updated” date at the top; and

Provide additional notice (such as a banner or email) if the changes are material.

Your continued use of the Services after the revised Terms become effective constitutes your acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Services.

15. Miscellaneous

Entire Agreement: These Terms, together with the Privacy Policy and any additional terms for specific features, constitute the entire agreement between you and us regarding the Services.

Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

No Waiver: Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations in connection with a merger, acquisition, or sale of assets, or by operation of law.
